Agricultural Land

Buying Agricultural Land in Gujarat

Agricultural land purchase involves strict legal restrictions on who can buy, tenure types, NA conversion requirements, tenant rights, and irrigation entitlements. Ignoring these can render the purchase void.

Property Buying

Key legal considerations

Step 01 Who Can Buy Agricultural Land in Gujarat?

Under the Gujarat Agricultural Lands Ceiling Act and the Gujarat Tenancy and Agricultural Lands Act (GTAL Act), 1948, only an "agriculturist" as defined under Section 2(2) can purchase agricultural land. A person is an agriculturist only if they personally cultivate land. Non-agriculturists (businesspeople, NRIs, companies) cannot directly purchase agricultural land without the Collector's special permission.

  • Verify the buyer's "agriculturist" status — obtain Form 7 from the Talati confirming agricultural occupation\nNon-agriculturists must apply to the District Collector under Section 63AA of the GTAL Act\nNRIs can inherit agricultural land but not buy it without RBI/government permission\nCompanies and firms are generally barred from buying agricultural land in Gujarat
Step 02 Land Classification and Tenure Types

Gujarat land is classified as Occupancy Class 1 (Khedu / owner-cultivated, free to sell) or Occupancy Class 2 (with government restrictions — requires Collector permission before sale). Agricultural land is further classified as Jirayat (rain-fed), Bagayat (irrigated), Pot-kharab (uncultivable — government property), or Gauchar (grazing land — cannot be privately owned).

  • Jirayat land: lower value, dependent on monsoon — check bore well potential and groundwater\nBagayat land: higher value — verify irrigation source (canal, bore, river lift) and water right certificate\nPot-kharab: belongs to government — never pay for pot-kharab area in a plot purchase\nGauchar land: legally non-transferable, any document purporting to sell gauchar is void\nOccupancy Class 2: must obtain Collector's permission BEFORE registration — without it, the sale is voidable
Step 03 NA Conversion: Agricultural to Non-Agricultural

Converting agricultural land to non-agricultural (NA) use is mandatory before any residential, commercial, or industrial construction. The process involves an application to the Collector's office with a proposed land use plan, payment of NA premium (fixed by the government), and obtaining a NA Order (NA Parvana). Without a valid NA Order, any construction is illegal and subject to demolition.

  • NA premium is calculated on the government jantri (ready reckoner) value — budget 15–25% of land value\nDevelopment Plan zone must be compatible with proposed use (e.g., agricultural land in residential zone qualifies for residential NA)\nAfter NA order, update the 7/12 to reflect NA status — the 7/12 must show "NA" in the land-use column\nTime to obtain NA: 3–12 months depending on the Collector's office and completeness of documents\nCheck if the NA order has conditions — some NA orders restrict the construction type, height, or timeline
Step 04 Tenant Rights and Tenancy Clearance

Under the Gujarat Tenancy and Agricultural Lands Act, long-standing tenants (ganotwallas) on agricultural land have protected rights and may have a statutory right to purchase the land. If you buy agricultural land that has an undisclosed tenant, the tenant's right survives the sale — you could lose possession.

  • Check Form 7 "Other Rights" column for any recorded tenancy\nObtain a Tenancy Clearance Certificate from the Mamlatdar before purchase\nIf a tenant exists, the landlord must follow the statutory process to terminate tenancy — not just a written agreement\nTenants who have cultivated the land for 3+ consecutive years may have a right to purchase at statutory rate
