Index 2: the registrar transaction log that exposes hidden sales and mortgages

What is Index 2?

Index 2 — formally the "Index of Registered Documents" maintained under the Registration Act, 1908 — is the chronological register kept by the Sub-Registrar of every document registered against a particular property. Every sale deed, mortgage deed, gift deed, lease deed, release deed, partition deed, court decree, and even a cancelled deed that touches a given survey number or property card number is recorded here in date order, with the document number, parties' names, the nature of the document, and the consideration amount. While the 7/12 and 8A show who the current recorded owner is, Index 2 shows the entire history of registered transactions — including ones the seller may have deliberately hidden from you. For title verification in Gujarat, Index 2 is the backbone document that ties the 30-year title chain together.

Why Index 2 matters more than the seller's word

A seller can show you a clean sale deed and a clean 8A, but neither of those documents tells you whether the same property was sold to someone else last month, or mortgaged to a bank last year. Only Index 2 reveals that, because every registered document — regardless of whether mutation was completed — leaves a permanent entry in the register. A fraudster can forge a 7/12 or hide a prior sale from the 8A, but they cannot erase an entry from the Sub-Registrar's Index 2. This is why every advocate conducting title verification begins by pulling the Index 2 for the last 30 years against the survey number or property card number.

  • Index 2 is maintained by the Sub-Registrar, not the revenue department — it is independent of the 7/12 and 8A system.
  • It records every registered document, even if the parties never completed mutation — so a "hidden" sale that never reached the 7/12 still appears here.
  • It shows mortgages (ગીરો), court decrees, and cancellations — encumbrances that the 8A may not yet reflect.
  • It is chronological, so you can trace the exact sequence of transactions and spot gaps or contradictions.

How to obtain Index 2 in Gujarat

There are two ways to obtain Index 2, and you should use the official route — never accept a copy from the seller:

  • Online via iGR Gujarat (igr.gujarat.gov.in): the digital Index 2 can be searched and downloaded using the survey number, village, and year range. This is the fastest method and produces a tamper-evident digital copy.
  • From the Sub-Registrar's office (રજિસ્ટ્રાર કચેરી): submit a written application with the survey number or property card number and the year range (request at least 30 years). The office issues a certified printed copy with seal and signature.
  • AVOID: an Index 2 printout handed to you by the seller or broker without a seal, signature, or digital barcode — it may be edited to remove incriminating entries.
  • For urban property, search by the property card number and the City Survey area; for agricultural land, search by the survey number and village.

How to read an Index 2 entry

Each row in the Index 2 register contains these fields. Learn to read every one:

  • Registration number and date (દસ્તાવેજ નંબર અને તારીખ): the unique number assigned when the document was registered, and the date of registration.
  • Nature of document (દસ્તાવેજનો પ્રકાર): sale deed, mortgage deed, gift deed, lease, release, partition, court decree, or cancellation.
  • Parties (પક્ષકારો): the names of the executant (seller/transferor) and the claimant (buyer/transferee).
  • Property description (મિલકતનું વર્ણન): survey number, area, and location.
  • Consideration (ગુણવત્તા / રકમ): the transaction value declared in the document.
  • Remarks (ટિપ્પણી): notes such as "cancelled", "mortgage discharged", or "court order" — read these carefully.

Real case example from Ahmedabad (2022)

A buyer in Bopal, Ahmedabad agreed to purchase a 200 sq yard residential plot for ₹1.4 crore. The seller showed a sale deed registered in 2019 and an 8A showing the seller as owner with a clean 12-year chain. The buyer's advocate pulled the Index 2 for the survey number for the last 30 years. The Index 2 revealed that in 2021 — two years after the seller acquired the plot — the seller had registered a mortgage deed (ગીરો) with a cooperative bank for ₹55 lakh against the same plot. The seller had never disclosed this mortgage, and the 8A did not yet reflect it because the bank had not initiated mutation. Had the buyer proceeded without checking Index 2, he would have inherited a ₹55 lakh mortgage and the bank could have auctioned the plot to recover its loan. The buyer renegotiated the price down by the mortgage amount and insisted the seller discharge the mortgage before registration. The lesson: Index 2 catches encumbrances that the 8A and the seller's story both miss.

Red flags in an Index 2 that should stop the deal

Examine the Index 2 carefully for these warning signs:

  • A sale deed registered after the date the seller claims to have acquired the property — indicating a possible double sale.
  • A mortgage deed (ગીરો) against the survey number that the seller did not disclose — the property is encumbered.
  • A court decree or attachment order — the property is under litigation.
  • A cancellation deed (રદ દસ્તાવેજ) — a prior transaction was cancelled, which may affect the chain of title.
  • A gap of many years with no entries for an old property — either the records are incomplete or transactions were deliberately not registered.
  • Multiple sale deeds for the same survey number to different buyers — a clear double-sale pattern.
  • A transaction value far below the market value — a possible benami or undervalued transaction to evade stamp duty.

Verification process — step by step

Follow this process to verify Index 2 before any property transaction:

  • Pull the Index 2 yourself from iGR Gujarat or the Sub-Registrar's office for the last 30 years against the survey number or property card number.
  • List every entry in chronological order — note the date, document type, parties, and consideration.
  • Cross-check each sale deed in the Index 2 against the corresponding 8A ownership history entry and the physical sale deed. Every transfer must have a matching registered deed.
  • Check for any mortgage deed — if one exists, confirm with the bank whether it has been discharged and obtain a no-objection certificate.
  • Check for any court decree or attachment — if one exists, do not proceed until the litigation is resolved.
  • Check for any cancellation deed — understand why a prior transaction was cancelled and whether it affects the current chain.
  • Re-pull the Index 2 within 7 days of your final registration — a fraudster can register a competing deed in the gap between your verification and your registration.

Protection strategies

To protect yourself using Index 2:

  • Always pull Index 2 yourself — never accept the seller's copy.
  • Request at least 30 years of records — the standard limitation period for title verification.
  • Engage an advocate to interpret the entries — a layperson can miss the significance of a mortgage or cancellation deed.
  • Re-verify Index 2 immediately before registration to catch any last-minute competing transactions.
  • Keep the certified Index 2 with your sale deed and 8A — together they form your complete title evidence.
  • If the Index 2 reveals an encumbrance, do not proceed until it is formally discharged and a fresh Index 2 confirms the discharge entry.
