INDUSTRIAL GIDC

Industrial Shed & GIDC Plot

99-year GIDC leasehold transfer, GPCB CTE/CTO consents, and tripartite mortgage NOCs

Property Buying

Key legal considerations

Step 01 GIDC Plot vs. Private Industrial Land

GIDC (Gujarat Industrial Development Corporation) allots industrial plots on a 99-year leasehold basis — you get a lease deed, not a sale deed. Transfer of a GIDC plot requires GIDC's prior written approval. Buying a GIDC plot from an existing lessee without GIDC approval means the "purchase" is void.

  • Obtain a No Dues Certificate from GIDC confirming all lease rent and charges are paid\nVerify the permitted industrial activity on the GIDC plot — GIDC leases specify allowed manufacturing categories\nGIDC transfer: pay applicable transfer fee (typically 5% of GIDC jantri value)\nPrivate industrial land: verify Development Plan zone — only land in Industrial Zone (I) or Special Economic Zone can legally be used for manufacturing\nCheck for pending GPCB violation notices or court orders against the seller
Step 02 Environmental Clearance and GPCB Compliance

Every industrial unit that generates effluent, emissions, or hazardous waste requires a GPCB Consent to Establish (CTE) before construction and Consent to Operate (CTO) before production. If you buy a factory that has outstanding GPCB violations, you inherit those liabilities as the new owner.

  • Obtain the current GPCB Consent to Operate (CTO) certificate — check its validity period and compliance conditions\nVerify the latest GPCB inspection report — any outstanding orders or pollution violations are a red flag\nCheck for hazardous waste disposal records — under Hazardous Waste Rules, these must be maintained for 5 years\nEffluent Treatment Plant (ETP): verify it is functional, not bypassed, and meeting discharge norms
