Residential & Apartment Title
Unregistered POA hiding an heirship dispute
Background
A family was buying a 3BHK flat in Vesu from a seller who produced a notarised Power of Attorney from his “uncle abroad” authorising the sale.
Problem identified
A notarised POA was presented as authority to sell. Records showed two legal heirs who had never consented.
Investigation
Our advocates pulled Index-2 and the mother deed. The “uncle” had died two years earlier; the POA had automatically revoked on death. Two legal heirs had never signed any consent.
Resolution
We renegotiated with a court-endorsed family settlement before registration, with both heirs as confirming parties.
Lessons learned
A notarised POA is not a registered POA. Verify the principal is alive and all heirs have consented.
They saved us from buying a flat we could never have legally owned.
