Residential & Apartment Title
Undisclosed bank charge on a bungalow
Background
A buyer was purchasing a bungalow in Bopal. The seller claimed the property was debt-free.
Problem identified
The Encumbrance Certificate produced by the seller showed a clean period, but a CERSAI search revealed a registered mortgage charge of ₹ 68 lakh.
Investigation
We obtained the EC directly from the sub-registrar and cross-checked CERSAI, which the seller’s EC had omitted.
Resolution
The seller’s bank issued a No Objection Certificate after the charge was cleared from sale proceeds, and registration proceeded safely.
Lessons learned
Always obtain the EC from the sub-registrar directly and check CERSAI for registered charges.
They found a charge the seller’s own EC had missed. We negotiated the clearance before paying.
